J'ai mis en place le premier volume du Livre: Quelqu'un peut-il m'aider, SVP? The problems of delaying the imposition of VLS sanctions once vexatious behavior has been identified, the lack of set procedures and poli- cies regarding the Vexatious Litigant List, and the failure to dismiss suits after vexatious litigants ignore orders requiring security have rendered the VLS ineffective. Under such circumstances, the VLS can neither act as a general nor a specific deterrent to those who repeatedly engage in ground- less litigation. The solutions offered above are strong steps toward making the VLS fulfill the purposes for which it was created.
These solutions, if implemented, either individually or collectively, may provide the courts with a truly viable vexatious litigant statute. It is thought to be both rare and resistant to treatment, especially when related to an organic condition, in which case a diagnosis of psychotic disorder due to a general medical condition would be appropriate. This report describes the successful treatment of a litigious delusional patient with pimozide. He wrote numerous letters to state and federal authorities charging unfair treatment by the courts and made death threats toward his sister that resulted in his arrest.

He was found incompetent to stand trial and subsequently was hospitalized. A had a premature and difficult birth. He was deaf since age 2, secondary to streptomycin treatment for an infection; developed conduct disorder at age 13; and abused alcohol from age 20 to age He developed a grand mal seizure disorder at age When he was 40, during the course of the work-up after his first seizure, a 5 cm left frontal lobe meningioma was diagnosed and resected.
He had been maintained on anticonvulsant therapy and remained free of seizures since his surgery. His most recent CT scan, at age 50, showed no regrowth of the meningioma or other abnormalities. On his initial mental status examination after hospitalization, Mr. A was clear and logical in his thinking and oriented to person, time, and place.
However, his affect was constricted, and he had prominent paranoid litigious delusions. An MRI revealed a 3 cm venous angioma in the right posterior temporal lobe. A was initially given prolixin, but it was discontinued after four weeks due to intolerance. He then was started on pimozide 2 mg per day, gradually titrated to 6 mg per day. After five weeks Mr. He no longer considered pursuing litigation or writing letters to various state and federal authorities, although he still felt that he was cheated of his share of the estate. He no longer threatened his sister and was discharged. He was subsequently linked to aftercare treatment and, six months later, had not been readmitted to our facility.
Isaac Wunder orders are named after the plaintiff in Wunder v. Irish Hospitals Trust,1 although they predate the decision in that case, having first arisen in this jurisdiction in Keaveney v. The defendant then applied to have all further proceedings stayed on the grounds that they were inter alia frivolous, vexatious and an abuse of process of the court. In the High Court, Murnaghan J. The Supreme Court examined its jurisdiction to control the administration of the courts, which derived from two sources, namely its inherent power and the Rules of the Superior Courts.
They did so by recasting personal traumas within the language of law and the nation-state, i. Attempts to distinguish these people from a control group on the basis of the manner in which their claims were initially managed failed. These complainants damaged the financial and social fabric of their own lives and frightened those dealing with their claims. In the process, they leave their own lives in chaos and show a significant potential for threats and violence. As government agencies, businesses, and professional organisations have established formal mechanisms for responding to complaints, so a small but vocal group of complainants has emerged which, by persistence and insistence, consumes disproportionate amounts of time and energy.
Standing to seek the order is usually restricted to an Attorney-General. But who was Millane and what prompted his declaration in ? What is its utility and the nature of the emerging legislative changes? Over the last 40 years, however, it has virtually disappeared from the professional landscape.

This decline occurred at the very time that a proliferation of complaint organizations and agencies of accountability were drawing more and more people into asserting their individual rights through the pursuit of claims and grievances. Querulous behaviour, as a result, far from declining, is on the increase, bringing with it suffering for the querulous and disruption to the organiza- tions through which they seek their vision of justice. This article examines querulous behaviour in the vex- atious litigant and in abnormally persistent complainants and petitioners. The phenomenological and nosological issues are outlined and the risks of the emergence of threatening and violent behaviour is emphasized.
Threats should not be ignored, for a variety of reasons. Approaches to managing querulous behaviour in the courts and the complaint organizations are discussed, together with the utility of individual therapy. Querulous behaviour should once more take its place among the legitimate concerns of mental health professionals. Those caught up in a queru- lous pursuit of their notion of justice are amenable to management that can ameliorate their suffering and re- duce the disruption they create. It is a simple question.
In the varied host of television dramas, attorneys, not the parties, are always arguing the cases. Such pro se appearances typically result in the parties being mocked, berated, and the law ignored. Making vexatious proceedings orders. Cluster into the age range In most of these cases, the litigant was initially defendant rather than claimant. Vexatious litigants are not just the unusually persistent, but those who have proved unusually persistent and particularly unsuccessful.
Paranoid delusions have recently become the focus of empirical research.

In this article, we review studies of the psychological mechanisms that might be involved in paranoid thinking and discuss their implications for forensic behaviour science. Paranoia has not been consistently associated with any specific neuropsychological abnormality. However, evidence supports three broad types of mechanism that might be involved in delusional thinking in general and paranoia in particular: There is some evidence that paranoia may be associated with hearing loss, and good evidence that paranoid patients attend excessively to threatening information.
Although general reasoning ability seems to be unaffected, there is strong evidence that a jumping- to-conclusions style of reasoning about data is implicated in delusions in general, but less consistent evidence specifically linking paranoia to impaired theory of mind. Finally, there appears to be a strong association between paranoia and negative self-esteem, and some evidence that attempts to protect self-esteem by attributing negative events to external causes are implicated.
Some of these processes have recently been implicated in violent behaviour, and they therefore have the potential to explain the apparent association between paranoid delusions and offending. Six years ago, a Supreme Court judge took the rare step of declaring Craigieburn man David James Lindsey a vexatious litigant for habitually suing without any reasonable ground.
Being declared a vexatious litigant effectively banned him from launching further court cases without first obtaining the leave of the Supreme Court. Now, Mr Lindsey has the tobacco giant Philip Morris in his sights, seeking smoking-related damages. In , Mr Lindsey unsuccessfully sued Philip Morris over lung disease and other conditions.
Unbowed, he sought leave from eight judges to sue Philip Morris in the County Court — and was finally granted it. But the Court of Appeal, in a unanimous ruling, found against the company on February 21, opening the way for Mr Lindsey to try again. The Project aimed to examine the capacity of people with a mental illness in NSW to: Final report Vexatious litigants persistently and habitually engage in legal proceedings, without having a legitimate claim requiring resolution. The vexatious litigant may sue in order to annoy, harass, or financially punish other people.
Vexatious litigants can strain court resources. They can waste the time of judges and administrative staff and prevent other, legitimate claims from being dealt with. They can also force other people to incur otherwise unnecessary legal bills.
