When was your hearing? You should have 30 days to appeal. Thank you for using the consultation link. Check your email and we can set up a telephone conference to discuss further. I may or may not have come to a complete stop, but in my opinion I made the right turn carefully and prudently. Are these cases still getting thrown out in Broward County? Is the Hollywood vs Arem case still an argument to be had? How do I get the information that my RLC ticket was reviewed by an officer and not sent from the vendor?
If it is reviewed by an officer, how effective of an argument is the Hollywood case is? Is my RLC ticket in broward county has a good chance of being thrown out in ? The city was Sunrise, FL, if that at all matters. You can probably still beat a ticket under the Arem case in Broward County.
Your chances are even better with a right on red. You would have to get the information by questioning the officer at the hearing about the ticket. I also offer consultations for case strategy: I want to first say thank you for this plethora of great information! I am in the midst of my RLC battle in Apopka, and that actually leads me into my first item…. Considering I went to the Administrative hearing, how does that impact my ability to continue fighting this?
In your experience, is this appeal process worthwhile? He and the officer just acted out their roles, and rendered a guilty verdict for all that I witnessed. Either way, is my likelihood of winning on appeal somewhere between slim and none? After the defendant stated that he timed the lights himself, the officer asked him whether it was during the day or at night that he timed it. They record the audio from these hearings, so I can provide further information if you would like.
Thanks for the comment! I actually won my personal red light camera case as an appeal from the administrative decision, so it is not impossible. You are on a strict timeline and must do it within 30 days. Your ability to win or not depends a lot on what evidence was presented at your hearing and what your basis for your defense is. That might be something you could get into evidence on appeal since I believe they record all the hearings together as part of one record.
If you would like help with appellate strategy I do offer consultations, more info here: I blew through the one on Colonial and Magnolia heading West this morning in light rain after getting distracted by the flash!

Noticed flashing on the right side of the road while approaching the intersection and looked hard to see what was happening and rolled through the red by mistake after realizing I was already mostly through the intersection. Could have been a dangerous distraction but thankfully the light must have just turned. Let me know if you end up getting the ticket in the mail. My son received a violation in the mail today in Orange County. Looks like he tolled through and made a roght on red in our vehicle. Right on reds arent illegal unless there is a sign. Send me an email with the video info at kelli theyogalawyer.
I read through your article. If I want to appeal the ticket the court address is at Kissimmee though. Thank you very much! Sounds like a private vendor, most likely American Traffic Solutions. Under the new law see the most recent article I posted: Thank you very much for the reply, I appreciate it!

I appreciate your opinion. That carve out provision is a problem since it basically says the vendor is an agent for the purpose of reviewing RLC tickets. I think it would be hard to win your case under that contract in light of the recent Jimenez decision. Now if it was a lawful right on red, or if the yellow time was set too low, or if there was some other legitimate reason for missing the light, then maybe.
But chances are low with that contract, unfortunately. Thank you very much Kelli! I appreciate your time and response. It was my fault indeed I just wanted to see if there is any way to minimize it.. Good afternoon Kelli and thank you for such great info on red light cameras in FL! In January, I received a notice of violation from Orlando stops saying that I had run a red light when I was turning left on red down a one way street.
I decided I would try and fight the infraction and patiently waited for a UTC. Unfortunately I never received a UTC, but in May I received a notice saying that my license was going to be suspended due to failure to pay a ticket that had been issued for a red light violation. I immediately contacted the Clerk of the courts where I was required to pay a fee to get my licence out of the suspension protocol it had been placed in and then requested a hearing. I was given a hearing date, but now my first child is scheduled to be born on the day of the hearing and I am within the 10 business days to move the hearing.
I am working on an affidavit of defense where I am stating that a UTC was never received and therefore I was not able to have a timely hearing because of it. Is there anything else I should mention in my statement? Sorry to hear about your predicament but congratulations on the birth of your child! That sounds good for the affidavit of defense though I am not an expert on those types of issues. Once you get passed the suspension issue to the actual red light camera hearing, let me know.
Add that argument to the fact that it sounds like you were making a legal left on red and you stand a very good chance of winning your RLC ticket. Hi Kelli, I really appreciate all of this information you have posted. It has been really helpful so far. I just received a red-light ticket in Orlando. With the video as proof, do I have any chance of fighting the ticket or would I be better off just paying the fine?
The Driver Is Usually Liable, Not the Owner
Thank you for all of your great advice! Hi Susie, sorry I am just seeing this. It is hard to fight RLCs in Orlando right now in light of recent case law. Those are still winnable. There is also an argument that can be made about the validity of the contract that I would be willing to help you with, but there is risk involved because there is a decent chance you lose. Hi Susie, I just got a citation from Winter Park Police on not making a complete stop on a red light when turning right.
I slowed down, stepped on the break and turned with safety. It may not be a complete stop but I did look and the traffic to my right was turning left so no traffic coming from my left and it was cleared on my right. The car in front of me did the same thing in the video. Thank you for all the advice.
Per the statute, s. I was cming to a yellow light and noticed I would not beat the light and started braking but the road was slick from rain and still raining. After passing the line, I noticed the light was already red and I drove forward to avoid reversing into cars dtiving to the intersection.
